Terms of Service

These Terms of Service ("Terms") govern your access to and use of Vivit.health (the "Service"), operated by Yummy Yums ("Yummy Yums", "we", "us"). By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

Vivit.health is an AI-powered recipe discovery and personalization app that adapts viral cooking content to your biological profile, dietary preferences, and nutrition goals. The Service is provided on a subscription basis with a limited free tier.

2. Eligibility & Account

You must be of legal age in your jurisdiction to enter into a contract. You are responsible for the accuracy of the information you provide, for keeping your credentials confidential, and for all activity that occurs under your account.

3. Acceptable Use

You agree not to misuse the Service. In particular, you will not:

  • use the Service for any unlawful, fraudulent, or harmful purpose;
  • infringe the intellectual property rights of Yummy Yums or any third party;
  • upload malware, attempt to probe, scan, or test the security of the Service, or interfere with its operation;
  • scrape, crawl, or otherwise extract content or data outside the intended user interface; or
  • resell, sublicense, or redistribute the Service without our written consent.

Vivit.health uses generative AI. You are responsible for the prompts you submit, for verifying the accuracy of any AI output, and for ensuring you have the rights to any content you upload. AI output is provided for general informational and culinary purposes only and is not medical, nutritional, or professional health advice. Always consult a qualified professional before making decisions that affect your health.

4. Intellectual Property

Yummy Yums retains all right, title, and interest in and to the Service, including its software, design, branding, and documentation. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with your active plan. You retain ownership of content you submit, and grant us a worldwide, royalty-free license to host and process that content solely to provide the Service to you.

5. Payments, Billing & Refunds

Payments are securely processed by Stripe. By subscribing, you authorise Yummy Yums (via Stripe) to charge your selected payment method on a recurring basis.

Subscriptions renew automatically at the interval shown at checkout (e.g. monthly) until cancelled. You can cancel at any time from inside the app; cancellation stops future renewals and you keep access until the end of the current billing period. Refund requests are governed by our Refund Policy.

6. Service Availability

We work hard to keep the Service running, but we do not guarantee that it will be uninterrupted, error-free, or available at all times. To the fullest extent permitted by law, the Service is provided "as is" without warranties of any kind, express or implied, including merchantability and fitness for a particular purpose.

7. Suspension & Termination

We may suspend or terminate your access to the Service at any time for material breach of these Terms, non-payment, suspected fraud or security risk, or repeated or serious policy violations. You may stop using the Service and cancel your subscription at any time. On termination, your right to access the Service ends.

8. Limitation of Liability

To the fullest extent permitted by law, Yummy Yums' aggregate liability arising out of or related to the Service is limited to the fees you paid to us in the twelve (12) months preceding the event giving rise to the claim. We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury caused by negligence where excluded by applicable law.

9. Indemnity

You agree to indemnify and hold Yummy Yums harmless from any claim arising from your content, your use of the Service in violation of these Terms, or your violation of applicable law.

10. Changes

We may update these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use of the Service after the effective date constitutes acceptance.

11. Governing Law

These Terms are governed by the laws applicable to the jurisdiction in which Yummy Yums is established. Disputes will be resolved by the competent courts of that jurisdiction, unless mandatory consumer law gives you the right to bring proceedings elsewhere.
